Membership
Each person who becomes a full member and his immediate family (25 years and
younger) will be entitled to use of all the golf and social facilities of the
club, upon payment of required membership fees and annual dues. Full members
will not be required to pay green fees for the use of the golf course, but will
be required to pay for golf buggies. The club will offer full memberships for property
owners and for owners of residential units sold on a corporate ownership basis
to multiple owners. Each such resident unit will count as one full membership,
and each owner of an interest (limited to four owners) will have full membership
privileges.
Rules and policies
To enhance the recreational and social pleasure of members and their guests, the
club reserves the right to establish or modify rules, regulations, policies and
guidelines. Members may request a change in the rules and regulations of the
club upon a two-thirds vote of the membership. Such request is subject to club
approval in its sole discretion.
Membership is by invitation only. An applicant who has been invited to apply for
membership must be mailed or deliver to the club manager at the club.
Honorary memberships
The developer will issue honorary memberships to distinguished persons. Honorary
memberships shall not count against the limit on the number of full memberships
and will be non-transferable. Honorary members will have the same privileges to
use the club facilities as full members.
Homeowner membership
The homeowner membership is available to property owners on the estate other
than where property is held in a legal name by two or more owners. The
membership will entitle the homeowner and his or her immediate family (spouse
and children under 25 years) full club membership. Each homeowner member may
purchase one additional membership (if available) for a friend and family
member. Membership fees and annual dues of said membership will be determined by
the club.
Corporate members
Corporate memberships will entitle four (4) registered owners or shareholders of
a company or members of a close corporation and their immediate family (spouse
and children under 25 years) full membership to the club. Multiple corporate
memberships, consisting of blocks of four individual or family memberships, may
be purchased by a corporation.
Outside members
The demand on limited outside members will be assessed by the developer during
the development period and thereafter by the club manager.
Two clubhouses
There will be two clubhouses: a members clubhouse located at the east end of the
course and a guest clubhouse located at the Village. The member clubhouse is for members
and their accompanied guests only. Exceptions will be made during the first year
of operations, while the guest clubhouse is under construction. The guest
clubhouse is for unaccompanied guests of members and other guest players.
Membership Rights
Membership in the club permits the member to the use of club facilities in
accordance with the membership rules. Membership in the club is not an investment
in the club and its facilities, and does not provide the member with an equity
or ownership interest in the club or its facilities. Membership will not be
entitled to vote or participate in the management of the club. If approved for
membership of the club, the member agrees to be bound by the terms and
conditions of the membership rules. The club reserves the right, in its sole
discretion, to reserve memberships, to terminate or modify its membership plan,
to discontinue operation of any or all the club facilities available for use of
members.
Transfer of Family Membership
A member may directly sell or transfer their membership to any party. Membership
is attached to the member and not the property. A person purchasing a membership
must submit an application to apply for membership at the club, along with two
references. All applicants are subject to approval by the club. If
the purchaser of a home or residence does not apply for membership within
30 days of the closing of their property or is not approved for membership, the
membership will be reissued by the club.
Members who sell their property at Oubaai
A member who sells his or her property at Oubaai may retain the membership, if
the member desires to do so.
Two waiting lists for membership
The club will maintain two waiting lists for memberships:
1) A waiting list for all property owners within the Oubaai Golf Estate who do
not have a membership - Oubaai waiting list.
2) A waiting list for all other prospective members. Individuals
on the Oubaai waiting list will have priority, subject to availability of memberships as
determined by the club from time to time.
Invitation for Membership
Initial memberships will be extended to property owners at Oubaai Golf Estate.
Invitation to apply for memberships is extended to persons selected by the club.
The clubs goal is to create and maintain a premier members club, which offers
world class golf and social facilities for members and their accompanied guests.
Application for membership
A person who has an invitation to apply for membership must submit an
application for membership to the club, along with two references and the
required membership deposit. All applicants are subject to approval by the club.
Membership privileges prior to closing
The club may allow the initial purchaser of a residency or developments as
determined by the club from time to time, to use the club facilities as a member
prior to the closing of his or her residence. The person will be required to pay
the applicable membership deposit, dues, fees or other charges established by
the club from time to time. In the event that a purchaser does not close on the
residence, the club may terminate the membership privileges by returning the
membership deposit and any unused portion of any dues, fees and charges paid by
the person in advance for the remainder of the membership year. In this event
the membership will thereafter be made available to the person only in the
discretion of the club.
Membership held in the name of legal entity
For the convenience of members, a membership may be held in the name of a
corporation, partnership, trust or other form of multiple ownership. Each entity
might purchase blocks of four family memberships per initiation fee. The entity
must designate the individuals or families who will have the right to the
membership. The designated users must submit an application for membership. The
designated user must be a bona fide director, officer, partner or shareholder of
the entity, or a beneficiary or settler if the membership is held in a trust,
and must pay the required dues and charges. No person after the designated user
and his or her immediate family will be entitled to use the membership. If the
entity acquires a transferability privilege, only the entity acquiring the
property will have the designated right to membership privileges. The club may
establish from time to time the rules governing the designated user of a
membership, including the limit on the number of times and frequency the
designated user may be changed.
